They don't handle EULA issues in this way, they wait for a complaint to act on, this is why you'll hear that xyz server is doing this or that in violation of the EULA, but yet they have not been forced to change. While MyM may be the statistically most popular modded network, we're still dwarfed by larger vanilla servers, who tend to hide behind their population when it comes to defending itself. As for anything you paid for under the tier system those privileges are protected under the current EULA so kit changes etc can still be done at the players request.
